GENERAL CONDITIONS OF SALE
Any order for products placed on the site y.inkonpaper.fr implies consultation and consequently the acceptance of these general conditions of sale.
The purpose of these General Conditions of Remote Sale is to define the rights and obligations of the parties in the context of the online sale of products offered in this electronic catalog to Customers. The offer is valid within the limits of available stocks.
1/ Order
Any order form signed by the Customer by the “validation click” constitutes an irrevocable acceptance by the Customer. The invoice acting as a guarantee voucher has a decreasing hierarchical legal value. The “validation click” of the order constitutes an electronic signature which gives value, between the parties, of handwritten signature.
The conclusion of the contract occurs only at the time of the confirmation of the order sent by e-mail by our site. This order confirmation will contain all the elements constituting the contract (products ordered, prices, delivery times, shipping costs.) This confirmation by e-mail signifies acceptance of the order and the method of payment by the site y.inkonpaper. Yann HUBERT reserves the right not to confirm an order for any reason whatsoever, in particular due to a problem with the supply of products or manufacturing, or to a problem concerning the order received.
It is up to the buyer to carefully check the elements he/she has transmitted in order to validate his/her order.
2/ Duration of the offer
The y-inkonpaper site markets original plastic or graphic works of art. The offers contained in the site remain valid as long as the products are offered online. However, the manufacture being artistic and unique for each product, it will not be possible to grant any compensation for a product sold out at the time of the order and therefore not deliverable.
3/ Prices
The prices are expressed on the Site in Euros. The price guaranteed to the buyer is the one displayed on the Site at the time of the purchase for a firm period of 30 days. The price fixed at the time of the purchase is firm and definitive, and does not take into account the participation in the expenses of delivery invoiced in more. The prices are indicated in “net price”. The VAT is not applicable (VAT not applicable, article 293B of the General Tax Code).
The payment of the totality of the price is due at the time of the order. It is this payment that triggers the execution of the order.
The goods are deliverable outside the French territory on request. Namely that all taxes and formalities generated will be fully supported by the customer.
The payment is carried out, at the time of the order, by bank card as proposed on the site (or by transfer in the event of sale on measure). The following cards are accepted: VISA, MASTERCARD and CARTE BLEUE. To ensure the security of payments, the site uses Paypal secure payment services. These services integrate the SSL security standard. Confidential data (16-digit credit card number, expiration date) are transmitted encrypted (coded) on the servers of banking institutions and are not transmitted to our server. At no time do we have access to your banking information. In case of payment by credit card as proposed on the Site as soon as the order form is sent to our company, the provisions relating to the fraudulent use of the means of payment provided for in the agreements concluded between the customer and the issuer of the card and between our company and its banking establishment apply. The customer guarantees our company that he/she has the necessary authorizations to use the method of payment by credit card, when validating the order form. The data relating to the bank card are neither held nor kept by our company during the payment. The validation of the order by means of the credit card number and the expiry date is equivalent to a mandate to pay the price appearing on the invoice (including taxes and participation in delivery costs) that the payment server transmits to the customer’s credit institution. In the event of a dispute over part of the invoice, the amount that is not subject to dispute must be paid on the contractual due date, with the disputed amount being paid as soon as the dispute is resolved.
4/ Retraction period
The customer has a period of seven working days from the delivery of the order to exercise a right of return, at his expense, for exchange or refund of products that do not suit him in accordance with Article L 121-16 of the Consumer Code. The product will be returned at the customer’s expense and must be in its original condition and packaging. It must not have been used, nor have suffered any deterioration, however slight, and be in a perfect state of cleanliness. Our company will proceed to the reimbursement of the goods within 30 days after return and verification of the goods under the condition that they are in perfect condition and in their original packaging. For this purpose, the customer will communicate his bank details. In case of deterioration of the goods or its packaging, a discount may be applied depending on the damage up to 80% of the purchase price.

6/ Order Confirmation
Each purchase made will be the subject of a confirmation by e-mail including:
The contact details of our company, the essential characteristics of the purchases made, the lʼindication of the net price, as well as the amount of the delivery charges; the method of payment paid subject to the bank transaction acceptance.
6/ Delivery
In the case of a commissioned work, the delivery times will be defined on a case-by-case basis, depending on whether your order concerns a drawing or a painting and on the size of the work. These deadlines will take into account the preparation and the execution itself. The execution of the work will only begin upon receipt of the deposit and an invoice will be sent to you as soon as the work is completed. Delivery times are from 1 (one) to 6 (six) weeks depending on the location of the artwork and the weight of the shipment. These orders will be processed as soon as possible upon receipt of the accepted quote.
In other cases, all orders will be processed within 3 working days after payment and then entrusted to a carrier. If a tracking number is available, it will be communicated to you in order to follow the progress of the delivery.
The delivery note given by the carrier, dated and signed by the customer upon delivery of the product will constitute proof of transport and delivery. Upon delivery, the customer must check the contents, the conformity and the condition of the product(s) before signing the acknowledgement of receipt of the package. If he/she notices any anomalies, he/she must refuse the delivery of the package or issue handwritten, precise and dated reservations. These reservations must be confirmed with the carrier by registered letter with acknowledgement of receipt within three working days following the delivery of the package. A copy will be sent to our company. The delivery address may be different from the one mentioned for invoicing.
Deliveries are made to the address indicated in the order form. The risks are the responsibility of the buyer from the moment the products leave our workshop. Not being able to be held responsible for the damage occurred in the course of road, in case of damage or loss during transport the protest must be formulated in registered letter with acknowledgement of receipt to the carrier within three days after the delivery.
7/ Delayed delivery
In case of unavailability of the ordered product, the Customer will be informed as soon as possible and will be able to choose : – wait for the availability of the product,
– to have a credit to be used on a later order,
– request a refund of the unavailable goods.
In this last case, the refund will take place at the latest in the thirty days following the complaint.
8/ Guarantee
The products sold benefit from the legal guarantee against hidden defects provided by articles 1641 and following of the civil code. In any case, each realization being carried out in an artistic way in single piece, it could not be exchanged or refunded under pretext of dʼune nonconformity visual or of dimensions. As far as dimensions are concerned, a tolerance of variation will have to be accepted as such. The dimensions announced on the site remain as an indication. A variation of a few centimeters can be noticed. As for the colors, the photos are corrected to reflect the real colors as well as possible, but they may nevertheless include minor differences in hue with reality. The buyer agrees to accept these tonal differences.
In order to avoid any inconvenience, the products are checked by our company before shipment. In the event of a warranty claim, the customer will return the product, at his own expense, after making a written request and after acceptance by our company, enclosing the original invoice. Upon receipt and after verification, the product will be exchanged for an identical product and shipped to the customer at the expense of our company, except in the case of disappearance of the product from the range or in the case of a unique part by definition not replaceable. In this case, our company will proceed to the reimbursement of the price of the product after reception of the bank details of the said customer.
10/ Intellectual property of the products
The brands and products are protected by the copyright of Yann Hubert. All rights concerning the entirety of the products sold on the website or through other distribution channels, are exclusively reserved to Yann Hubert. Copyright in France is governed by the law of March 11, 1957 and the law of July 3, 1985, codified in the intellectual property code.
In sum, all intellectual property rights attached to the product remain without reserve the full and complete property of Yann Hubert
Any reproduction, representation, use or modification, by any means whatsoever, of all or part of a creation, without having obtained the prior authorization of Yann Hubert is strictly prohibited and constitutes an infringement.
11/ Intellectual property of the site
All the elements of the site ” www.y-inkonpaper.fr “, all the texts, all the literary, graphic, phonographic, photographic, scenographic data, and works presented on the site are protected by the royalties and the intellectual property.
Unless expressly authorized in writing, the reproduction and any use of the works, other than for individual and private consultation, are prohibited.
Any reproduction, representation, use or modification, by any process whatsoever and on any medium whatsoever, of all or part of a creation, without having obtained the prior authorization of Yann Hubert is strictly prohibited and constitutes an infringement.
12/ Applicable law
Any dispute or litigation that may arise between the buyer and the seller will be settled by arbitration. The applicable law is the French law.
